These Terms of Service govern your use of Match Mindset, operated by Berger Consulting Services, LLC DBA Match Mindset. By accessing this website or purchasing coaching services from Match Mindset, you agree to the following terms and conditions. Please read them carefully before making a purchase or booking a session.

About Our Services

Match Mindset provides mental performance coaching and sports psychology coaching services to athletes of all ages and levels. All coaching services are provided by Annie Berger, Certified Mental Performance Consultant (CMPC), certified by the Association for Applied Sport Psychology (AASP).

Mental performance coaching is not therapy, counseling, psychotherapy, or any form of licensed mental health treatment. Coaching focuses on performance skill development and does not diagnose, treat, or address clinical mental health conditions. Match Mindset is not a healthcare provider and is not subject to HIPAA regulations. If you or your athlete is experiencing a mental health crisis or requires clinical support, please seek assistance from a licensed mental health professional.

Who We Work With

Match Mindset works with athletes ages 14 and up, as well as younger athletes in certain competitive environments as determined on a case by case basis. By purchasing services for a minor, you confirm that you are the parent or legal guardian of that athlete and consent to their participation in coaching. Purchasers of coaching services must be 18 years of age or older.

Sessions

Sessions are conducted virtually via video call or in person at New Rochelle Racquet Club in New Rochelle, NY. Session length varies by age and package. All scheduling is managed through our booking system and confirmed via email.

Payments

Payment is required at the time of purchase. All prices are listed in US dollars. By purchasing a coaching package, you agree to pay the full amount listed at checkout. Payment is processed securely through Kajabi and Stripe.

Cancellations and Rescheduling

We understand that schedules change. We ask that you provide at least 24 hours notice to cancel or reschedule a session. Sessions cancelled with less than 24 hours notice or missed without notice may be forfeited at the coach's discretion. We will always do our best to work with you on rescheduling when circumstances arise.

Refund Policy

Coaching packages are non-refundable once purchased. If exceptional circumstances arise, please reach out directly at [email protected] and we will do our best to find a fair solution.

Confidentiality

All information shared during coaching sessions is kept strictly confidential. Notes and session content will not be shared with third parties without your explicit consent, except where disclosure is required by law. For minors, parents or guardians may receive general progress updates as agreed upon at the start of coaching.

Parent and Guardian Involvement

When working with minor athletes, Match Mindset may periodically communicate with parents or guardians regarding general progress. The content of individual sessions remains confidential to support the athlete's trust and development.

Photo and Video Consent

Match Mindset may occasionally photograph or record in-person sessions or events for educational or marketing purposes. By participating in in-person sessions, you consent to this use. For minor athletes, parent or guardian consent is required before any photos or videos are taken or used. You may withdraw consent at any time by contacting [email protected].

Communications

By purchasing services or submitting your contact information through this website, you agree to receive emails related to your coaching services. You may also receive occasional updates, resources, or announcements from Match Mindset. You can unsubscribe at any time by clicking the unsubscribe link in any email or contacting us directly.

Intellectual Property

All content on this website, including text, images, written materials, and coaching tools, is the property of Berger Consulting Services, LLC DBA Match Mindset and may not be reproduced, distributed, or used without prior written permission.

Limitation of Liability

Match Mindset makes no guarantees regarding specific outcomes from coaching services. Results vary by individual, level of commitment, and personal circumstances. Berger Consulting Services, LLC DBA Match Mindset and Annie Berger are not liable for any decisions made or actions taken as a result of coaching sessions.

Dispute Resolution

In the event of a dispute arising from these terms or our services, both parties agree to first attempt to resolve the matter informally by contacting [email protected]. If the dispute cannot be resolved informally, it shall be governed by the laws of the State of New York, without regard to conflict of law principles.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of New York.

Changes to These Terms

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated date. Continued use of our services following any changes constitutes acceptance of the revised terms.
